Our terms and conditions apply to all transactions on the Apinya website and are set out below. Please read through these carefully before placing your order.
Basis of Sale
When you click on "Purchase" at the checkout, you agree to buy the Goods at the prices indicated including any delivery charges that apply to your purchase. All orders will be subject to these conditions.
If your order is accepted, you will be notified of this soon after you submit your order by clicking "Purchase". As the confirmation is sent to you automatically, an error may have been made of which we are not aware despite our best efforts. Because of this, we retain the right to cancel the order as set out under the "Price/Payment" heading below.
Price/Payment
All prices are quoted in pounds sterling and are inclusive of VAT
Under normal circumstances, the price you pay is the price displayed on this website at the time we receive your order. While we try and ensure that all prices on our website are accurate, if we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling the items in error. If we are unable to contact you we will treat the items in error as cancelled. If you cancel and have already paid for the items in error, you will receive a full refund for the cancelled items.
Availability
All orders are accepted subject to availability.
In the event that a product becomes unavailable after you have submitted your order, or we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
Delivery Of Order
We make every effort to deliver goods to your home within 14 days in the UK, however delays are occasionally inevitable.
Please allow 14 days for deliveries before contacting us on 07730 584240 (if outside of UK please call +44 7730 584240).
Unless we have stated otherwise in writing, delivery dates are not guaranteed, although we shall make every reasonable effort to deliver the goods by any quoted delivery date.
We require a signature for receipt of goods on delivery. If the mode of delivery is Royal Mail and you are not at the delivery address at the time of delivery, your order will be held at the nearest Post Office to be picked up at your convenience. If the mode of delivery is by a delivery service (generally for larger items over 20kg) we will telephone you in advance to arrange an appropriate time to deliver the goods. The customer needs to be present to sign for the delivery of the goods.
It is the customer's responsibility to ensure that the premises to which the goods ordered are to be delivered to are fully accessible for such purposes. We do not accept any liability in the event that delivery cannot be made, or is delayed due to any access to the premises or any part thereof being too small or otherwise unsuitable for such purposes.
In the event that any of the goods ordered cannot be delivered for any of the above reasons and no damage has been incurred to the goods we agree to the return of such goods, but all costs associated with initial delivery and collection shall be borne by the customer.
We are very happy to accept orders from all over the world although we will have to quote delivery charges separately and cannot be held responsible for any local import duty at destination.
Descriptions and Products
As many of the items available from Apinya are hand finished, there may be variations in colour and texture within each piece.
Reclaimed aged wood is used in the manufacture of some of the products. Although this minimises cracking, there is the possibility that some cracking or splitting over time is inherent in the nature of the traditional materials used and does not constitute a defect in the product of any kind.
Photographs shown on the Web site and catalogue are for illustrative purposes only, and may not exactly match the product itself. While every effort is made to ensure the accuracy of colour reproduction, colour may vary according to the settings of the purchaser's monitor, software or printer.
All measurements shown on the Web site and catalogue are approximate.
Cancellation
Under the Consumer Protection (Distance Selling) Regulations 2000 you have a statutory right to cancel your order and receive a full refund for any item or service, apart from items personalised for you. You may cancel your order by sending us a letter, fax or e-mail at any time up to and including the seventh day (excluding Saturdays, Sundays and public holidays) after the day on which you receive your purchase. To contact us for this purpose please call 07730 584240 (if outside of UK please call +44 7730 584240) from 9.30am – 5.30 pm (UK time) Monday to Saturday. If you exercise your statutory right to cancel you must immediately return the unwanted items following the packaging instructions in the "Guarantee" section below.
Guarantee
We trust that you will be delighted with your Apinya purchase, but if you find it unsuitable or not entirely to your satisfaction, provided you notify us within 7 days and return it to us within 28 days unused and in its original packaging and in perfect condition, you will be entitled to a full refund. (NB. please note that refunds will only be given provided we receive a completed returns form). Please ensure that it is packed and labeled carefully so that it is not damaged or lost in transit as the goods are at your risk until they are returned to us. This does not affect your statutory rights.
Returns
In the unlikely event that your purchase is faulty, we will refund or exchange the purchase and the cost of returning the goods. Please refer to the Returns Form for details of returning your purchase.
Please refer to “Guarantee” Section above for information on packing. Please ensure items are appropriately packaged prior to collection.
Unwanted Goods
If your item is unwanted we will refund or exchange, however we require you to cover the cost of the goods being returned as follows:
Items delivered to you using Special Delivery: should be returned using Special Delivery via your nearest post office.
Items delivered by Carrier: Please contact Apinya at telephone number 07730 584240. If outside of UK please call +44 7730 584240) from 9.30am – 5.30 pm (UK time) Monday to Saturday and we will arrange collection of the item(s) being returned within 14 days and charge you a non-refundable collection charge not exceeding the original delivery charge
Data Protection
To comply with the Data Protection Act (1984) we are required to inform you that we have recorded your name and address on our computer for the sole purpose of processing your order and keeping you up to date with Apinya news and offers. Your name and address will not be given or sold to third parties. Please let us know if you object to our keeping this information, and we will delete it.
Intellectual property and right to use
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
You acknowledge and agree that the material and content contained within this website are made available for your personal, non-commercial use only and that you may, if necessary, to make a purchase on this website download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of this website is strictly prohibited. You agree not to personally or assist or facilitate any third party to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
General
No order is binding on you or Apinya until we have accepted it. You will own the items we supply from the moment they are put in the hands of the postal service, or with our carriers, or on payment in full of the price of the Goods and any delivery charge, whichever is later.
All prices are subject to change without notice.
Each provision of this agreement is separable from the whole. If any portion of the agreement is determined invalid, that invalidity shall not impair the remaining provisions of the agreement.
Sales on this web site are governed by English law and you agree to submit any dispute to the exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions, and no amendments will be accepted by us.
